All passengers agree to these terms and conditions and rules of conduct on all trips offered by Rochester Trolley & Tour Co. Purchase of a ticket is your agreement to these terms.


Rochester Trolley & Tour Co. Terms and Conditions

1. Deposits and Payments

A deposit is required for multi-day and special event tours to hold a tour reservation. Deposit amounts vary by tour and are generally listed with tour pricing. No deposit is required for most local and day tours, as full payment is due at the time of booking.

Unless otherwise specified, balance payments are due as follows:

  • Multi-day and special event tours: Payment is due approximately 60 days prior to departure.
  • Local Public Tours: May be booked up to 30 minutes before departure, subject to availability.

Reservations may be accepted after the final payment deadline if space is available, though departure locations may be limited, and price increases may apply.

If discounts are available, only one discount per person is permitted and will be applied to the final payment.

Failure to make payment by the due date may result in cancellation of the reservation without refund.

2. Cancellations and Modifications

Rochester Trolley & Tour Co. reserves the right to cancel or modify any tour for any reason, including but not limited to low enrollment or concerns regarding traveler safety.

  • If a tour is canceled before departure, travelers will receive a full refund of payments made, including travel protection premiums.
  • If a tour is modified due to unforeseen circumstances (e.g., weather, venue closures), Rochester Trolley & Tour Co. will attempt to provide an alternative activity or extend time at other scheduled locations.

All tours generally require a minimum number of travelers to operate. If a departure is canceled due to low enrollment, affected travelers will receive a full refund.  A 4% credit card fee will be deducted for trips that were scheduled for a duration of more than one day.

3. Vehicles and Equipment

Rochester Trolley & Tour Co. reserves the right to substitute vehicles as necessary. If a significantly different vehicle is used, we will attempt to notify travelers in advance.

4. Travel Protection Plans

Travel protection plans help protect against trip interruptions, delays, medical emergencies, and baggage loss. If purchased within 21 days of your initial tour deposit, some plans may waive the pre-existing medical condition exclusion (provided you are not disabled from travel at the time of purchase).

Travelers who decline travel protection assume full responsibility for any cancellation penalties, out-of-pocket expenses, and emergency arrangements.

5. Photo and Video Consent

During the tour, Rochester Trolley & Tour Co. team members or fellow travelers may take photos and videos for promotional use. These images may be published on websites, social media, television, brochures, and other media.

By booking a tour, you grant permission to use your image and likeness. If you do not wish to be included, you must notify Rochester Trolley & Tour Co. in writing before your departure.

6. Passenger Conduct and Removal

All passengers must be at the designated departure point on time. If a passenger fails to arrive or cannot be reached, the tour may depart without them. In such cases, the passenger is responsible for arranging their own transportation to the next meeting point.

Passengers who engage in disruptive, unsafe, or disorderly behavior may be removed from the tour at the discretion of Rochester Trolley & Tour Co. staff. If necessary, law enforcement may be contacted.

  • Removed passengers are responsible for all costs associated with returning home, including transportation, fines, damage costs, or other fees.
  • No refunds will be provided for passengers removed due to misconduct.

7. Liability and Disclaimers

Rochester Trolley & Tour Co. is not responsible for lost, damaged, or stolen belongings.

Rochester Trolley & Tour Co., including its owners, employees, drivers, and agents, assumes no liability for:

  • Personal injury, illness, death, or property loss due to slips, trips, falls, weather, or other conditions beyond its control.
  • Acts of nature, disease outbreaks, war, civil unrest, labor strikes, terrorist activity, mechanical failure, or human error.
  • Passengers whose travel documents are incorrect, insufficient, or expired.

Limitation of Liability:
Nothing in this agreement shall be construed as a waiver of liability for gross negligence, reckless conduct, or intentional misconduct by Rochester Trolley & Tour Co., as prohibited by Minnesota law.

8. Force Majeure (Unforeseen Circumstances)

Rochester Trolley & Tour Co. is not liable for failure to perform obligations due to events beyond its control, including but not limited to:

  • Natural disasters (e.g., floods, tornadoes, wildfires)
  • Government restrictions, pandemics, or public health emergencies
  • Acts of terrorism, war, or civil unrest

If a tour is canceled due to such events, refunds or credits may be issued at the company’s discretion.

9. Governing Law and Venue

These terms and conditions shall be governed by and interpreted in accordance with the laws of the State of Minnesota.

Any disputes arising from these terms shall be resolved exclusively in the courts of Olmsted County, and / or the State of Minnesota. 

10. Specific Trips

Specific trips may have additional or alternative terms and conditions than those listed above. Please review the terms and conditions in the specific trip.

11. Contracting of Trips

Rochester Trolley & Tour Co. may partner with other tour companies to offer tours to other destinations. Those tours are governed by these Terms and Conditions and there terms and conditions as well. The partner's terms and conditions supersede ours during the trip.

Rochester Trolley & Tour Co. may from time to time contract with other companies to provide transportation that is booked with our company. This may include vehicles, drivers and


Coach Bus Code of Conduct & Safety Rules

  • Follow Instructions – Passengers must follow the driver’s directions at all times. If the driver is unable to do so, the tour guide (if present) will take charge.
  • Respect Others – Keep conversations, music, and electronic devices at a respectful volume.
  • Seat Belt & Seating Safety – Remain seated with seat belts fastened (if available) while the bus is in motion. If movement is necessary, use handrails for stability.
  • Boarding & Exiting – Use three points of contact when entering or exiting the bus.
  • Contact Information – Passengers must provide a reachable phone number to the driver or tour director when away from the group.
  • Punctuality – Arrive at the departure location at least 10 minutes early. Late passengers risk being left behind.
  • Emergency Preparedness – Familiarize yourself with emergency exits and their operation. In an emergency evacuation, leave personal items behind and exit quickly to the designated area.
  • Smoking & Vaping – Strictly prohibited by federal law.
  • Cleanliness – Keep your area tidy. Trash bags will be provided.
  • Food & Beverages – Only bring drinks and snacks that can be closed or resealed to prevent spills.
  • Safety Line Rule – Do not stand forward of the white line while the bus is moving.
